According to the American Bankruptcy Institute, the number of Texas non-business bankruptcies in 2011 (48,442) reflected a 10.5% decrease vs. 2010, lower than the 11.3% rate of decline in total U.S. 2011 non-business bankruptcies. Julia Gibbons, chair of the Judicial Conference of the United States, which manages 400 federal courts, indicated that “…declining consumer debt levels and a pause in home foreclosures contributed to the recent decline in filings.” Her projections assume consumer debt levels will begin to climb again, resulting in more bankruptcies in 2013. In addition, if home foreclosures increase, then bankruptcies will grow at an even faster pace than the level projected for 2013.
