Overtime pay at a rate not less than one-and-a-half times the regular rate of pay is required after 40 hours of work in a workweek. Most workers are entitled to a minimum wage of not less than $7.25 per hour. It does not matter if you agreed to work for less than the minimum wage, because you cannot waive your right to fair compensation. The rule is that your employer must pay you the right amount if he or she allows you to work overtime, for all the time you worked.
Mr. Akin further stated that, according to the FLSA, “An employee can file a private suit against his or her employer if they have refused to pay the employee overtime or a minimum wage.
