A Complaint has been filed by the court appointed Chapter 7 bankruptcy trustee in the United States Bankruptcy Court for the Eastern District of Tennessee (Case No. 20:09-BK 53160, adv. Proc. 11-5011) alleging that DBG acquired all of the assets of Phoenix EQ Holding Company (formerly known as EcoQuest Holding Corp) in a transaction that amounted to a Fraudulent Transfer, both under Bankruptcy Law as well as applicable state law. The lawsuit seeks to undo these transfers, and also seeks monetary damages against Vollara and individuals associated with DBG and Vollara, including DBG’s and Vollara’s CEO Joe Urso.
