Justices of Appellate Division Of The Supreme Court, First Judicial Department, Appoint Jeff Lichtman To Character And Fitness Committee

Serving on the Character and Fitness Committee for the First Department is an honor for Jeff Lichtman and recognizes his commitment to the ethical practice of law in this state.

On May 16, 2012, attorney Jeffrey A. Lichtman of Trolman, Glaser & Lichtman, began participating in the evaluation of candidates for admission to the State Bar of New York. As a member of the Character and Fitness Committee, Lichtman will review the past conduct of candidates for admission to the bar to ensure that each is reliable, trustworthy, honest and diligent.

The Character and Fitness Committee evaluates applicants to the State bar based on required submissions, including a questionnaire, affidavits of good moral character, certificates from each law school attended and other documentation. The First Department Character and Fitness committee reviews submissions on a rolling basis and conducts interviews with prospective attorneys approximately every three to four weeks.

If particular conduct in a candidate’s history raises a concern, the Committee will further investigate whether that person should be allowed to become a licensed attorney in New York. For applicants who do not pass the initial character and fitness review, the Committee will hold a hearing that allows the applicant to rebut any evidence that he or she is not of proper moral character and otherwise challenge the denial of admission to the New York State Bar.

Without a certification from the Committee on Character and Fitness, an applicant will not be sworn into the New York State Bar. As a member of the Character and Fitness Committee, attorney Jeff Lichtman will be working to ensure that those admitted to the practice of law are of good moral character and fit to practice law in New York.

Candidates that pass the bar exam, the M.P.R.E. and the character and fitness evaluation are typically sworn in a week after their interview with the First Department committee. The First Department Character and Fitness Committee also evaluates the fitness to practice of attorneys seeking admission to the New York bar on motion and foreign attorneys who wish to be licensed as a legal consultant in New York.
