Personal injury attorney Michael A. Madonna of Trolman, Glaser & Lichtman in New York City recently obtained a jury verdict (index #116416/2008) on behalf of the family of a 69-year-old woman who was killed after being run over by a bus operated by the New York City Transit Authority (NYCTA).

According to documents filed in court, the 69-year-old woman was hit by a city bus as she crossed the street in a crosswalk. She was rolled under the bus, the rear wheel running over her head. She was found almost 35 feet past the crosswalk. There were no witnesses to the accident. The bus driver, unaware that he had hit someone, left the scene.

After a three-week trial in the Supreme Court in New York County, the jury reached a verdict on April 11, 2012. Court records show that after finding that the bus driver and the NYCTA were 100 percent responsible for the wrongful death of the woman, the jury awarded her estate and family $800,000.

According to the lead attorney on the case, the matter turned on expert forensic evidence and testimony by an accident reconstructionist, which helped established the manner in which the accident occurred. This evidence helped determine that deceased plaintiff was free from any negligence. The jury awarded $250,000 for the seconds of pre-impact terror the woman experienced, $500,000 for several seconds of pain and suffering as she was rolled under the bus, and an additional $50,000 given to her adult son with whom she lived to compensate for his pecuniary loss, according to court records.
