Marc S. Albert Files Medical Malpractice Lawsuit on Behalf of Brain Injury Victim

Woman who went to Montefiore Medical Center for "simple" hernia operation suffered severe brain damage.

Marc S. Albert has filed a medical malpractice lawsuit on behalf of Patricia Imperati's family after the mother of four suffered severe brain damage following hernia surgery. The family told the New York Post about how they watched their mother deteriorate over the course of three weeks at Montefiore Medical Center.

Marc S. Albert called the case of Patricia Imperati "a comedy of errors" and "inept medical care from start to finish." The filing alleges several points of medical malpractice including:

  •     Failure to properly assess Imperati and inform her of risk associated with procedure
  •     Failure to properly close initial incision site, leading to internal bleeding
  •     Failure to act while an infection worsened
  •     Failure to attend to Imperati during recovery, leading to Stage 4 Bedsore--a bedsore with exposed bone

This Patricia Imperati lawsuit comes in the wake of allegations that medical negligence led to the death of an organ donor at Montefiore in May.

A spokesman for Montefiore said the medical center "strongly [disputes]" the "version of the events" presented by the Imperati family.

Imperati is currently confined to a nursing home. She has not been home since the surgery last summer.

The case has been filed in Supreme Court, Bronx County, index number 21143/2012E.
