According to InsideARM, just yesterday, U.S. Senator Al Franken introduced a series of two new bills on Wednesday which added new rules for medical debt collection companies and those related in healthcare to follow. While one of the bills addresses the protection of electronic information belonging to patients, the second bill has far more detail revealed.

The End Debt Collector Abuse Act of 2012 states, simply, that federal debt collection law has one too many gaps. Debt collectors have approached the indebted in emergency rooms, which is considered a complete invasion of personal privacy.

The Fair Debt Collection Practices Act would have the EDCAA added in so that new ideals are implemented. In essence, it will be made illegal for debt collectors to contact consumers while in emergency rooms. The use of protected health information is also against the law. Patients are also helped by the way of accessing financial assistance. Many patients aren’t aware that such a program exists in which people can be helped and this law helps to keep said patients updated. Honest debt collectors are kept and dishonest debt collectors are weeded out thanks to another addition to the bill in which bad actors are held accountable. Patients can sue debt collectors if they break the law, giving debt collectors more of a reason to follow the rules.

“I think it’s great,” said John Monderine, President and CEO of debt collection agency, Rapid Recovery Solution, Inc., in regards to the bill. “Medical debts shouldn’t be collected when people are in the hospital,” He would go on to cite a personal experience he had with such a case, thereby empowering his support toward the bill, “My mother had to deal with the same thing [while she was in the hospital].”

The EDCAA has many supporters, both in Minnesota and abroad. National organizations such as NAACP have endorsed Franken’s new bill, strengthening it all the while.
