Los Angeles personal injury law firm Magaña, Cathcart & McCarthy will participate in ongoing litigation involving the manufacture of pioglitazone, marketed as Actos, a blood sugar control drug for diabetics that may be linked to bladder cancer in patients. After the Food and Drug Administration changed its labeling requirement for Actos in 2011, litigation began to take shape, and Magaña, Cathcart & McCarthy will be on the front lines of the legal battles to come.
“This is obviously a very serious issue,” said Carter Spohn, administrator for the law firm. “People expect a certain level of safety from drugs and for it to, perhaps, give you bladder cancer is unacceptable. Bladder cancer treatments can get very expensive, and someone should help pay for the treatment of the victims of this drug, who trusted the makers of these drugs.”
In August 2011, The Food and Drug Administration (FDA) changed the required labeling on the Actos bottle so that it must include information that using pioglitazone for more than one year may be associated with increased risk of bladder cancer. Although there is no recall in the United States for now, France completely recalled the drug and Germany ceased its use – so it's likely that Actos injury claims have a strong case.
“People who are affected by bladder cancer often accumulate large medical bills for expensive treatments,” Carter Spohn said. “If their disease was caused by a drug they took, or any other defective product, they could be entitled to a sizable sum of money.”
