Hartline Dacus Barger Dreyer LLP attorneys Jim Corbett and Donald Crump won a $1.47 million verdict for their clients following a jury trial in litigation over a complex business dispute.
This complicated case arose from a dispute between business partners who began as friends. The four individuals started a company to develop, manufacture and sell drill bits in China. Over time, the relationships between the owners deteriorated, causing a division between them. Two of the owners filed suit against the other two. The two individuals that were initially sued engaged HDBD to defend them against the plaintiffs’ allegations of breach of fiduciary duty and interference with business relationships.
After uncovering evidence that HDBD’s clients had been the victims of unscrupulous business practices by their former partners, Mr. Corbett and Mr. Crump filed a separate lawsuit against the plaintiffs for breach of fiduciary duty, breach of contract and fraud. The two cases were ultimately consolidated.
Although the original plaintiffs dropped their claims against HDBD’s clients just before trial, Corbett and Crump aggressively pursued their clients’ claims. At trial, the evidence showed that the two partners who had initiated the litigation had sold the company’s assets to a newly-formed shell company without informing their partners (HDBD’s clients). After a ten-day trial, the jury returned a verdict in favor of HDBD’s clients, finding the counter-defendants liable for breach of fiduciary duty and fraud. The jury awarded HDBD’s clients $1.47 million in damages.
“When our clients were sued, we didn’t think it was enough to solely defend them,” said Jim Corbett, an attorney in the Houston office of HDBD. “The only fair and just outcome was to counter-sue and win them a judgment to recover the financial losses created by the actions of their former partners.”
