New and very little known provisions to the Affordable Care Act will assist in protecting hospital patients from being hassled by aggressive medical bill debt collectors. Minnesota senator Al Franken has introduced a legislation to further defend patients against collection harassment.

On July 16, 2012, Rapid Recovery Solution, Inc., became aware of an article from ABC regarding new provisions in the Affordable Care Act. The provisions are meant to protect Americans with overwhelming medical bills from what some consider persistent and unforgiving medical debt collectors. The little known provisions of the act put limitations on harassing medical debt collectors, stopping them from abusive collection methods. The provision will defend patients who need medical assistance during the screening and admittance procedure. In addition, patients will be protected against harassing collection for previous unpaid medical bills.

In April 2012, there were reports that one medical bill debt collection agency in Minnesota disguised their collectors as hospital employees. After the collectors infiltrated emergency rooms, they pressed for payment, threatening that medical treatments would not be given if patients couldn’t pay. There are additional reports claiming that collectors are asking for “point of service” payments from patients before they receive medical treatments. Actions such as these can discourage patients from receiving proper treatment, which can be life threatening.

These disturbing reports have disheartened Minnesota Senator Al Franken. Franken responded by introducing legislation to stop debt collectors from harassing patients in delivery wards, intensive care units, and emergency rooms. Franken also demands that health providers attempt to protect patient medical information by requiring an encryption of laptops and portable devices that have patient information stored.

Franken is hopeful that these measures will ensure the stop of intimidating medical bill debt collectors. His legislation will extend to all of the hospitals that are existing Treasury Department regulations under the Affordable Care Act, banning debt collection activities in the emergency departments of federally subsidized hospitals.
