Advertising for Skechers Shape-Ups toning shoes claimed that the shoe’s rocker bottom sole design would allow users to “Shape Up While You Walk” and “Shape Up While You Work.” Wearing Skechers Shape-Ups in place of other athletic shoes during daily activities, exercise routines, and in the workplace was supposed to provide the wearer with numerous health benefits, including improved cardiac function. However, according to an article published by Consumer Reports in 2011, toning shoes like Skechers Shape-Ups had been in named in more injury reports than any other product in its database. In May 2012, Skechers, USA, Inc. reached a settlement with the U.S. Federal Trade Commission (FTC) to pay $40 million to resolve charges that the company made deceptive claims about the health and fitness benefits of its toning shoes, including Skechers Shape-Ups. The agreement requires Skechers, USA, Inc. to pay refunds to consumers who purchased the company’s toning shoes, and prohibits the company from making future claims about certain health and fitness benefits “unless they are true and backed by scientific evidence.” However it should be noted that the FTC’s settlement does not address injuries allegedly caused by Skechers Shape-Ups, which is the focus of the lawsuits currently pending in the Western District of Kentucky.
