ASR Hip Implant Products Liability Litigation (“MDL No. 2197”), which is currently underway in the U.S. District Court for the Northern District of Ohio.* All of the metal-on-metal hip lawsuits filed in federal court by plaintiffs who received recalled DePuy ASR hip implants are pending before the Honorable David A. Recent Developments Affecting Metal-On-Metal Hip Lawsuits
Since the last status conference in the DePuy ASR hip litigation on June 5, 2012, a public advisory committee to the U.S. Food and Drug Administration (“FDA”) convened for a two-day session to discuss the safety of metal-on-metal hip implants.**** The public hearing focused on the following issues:
- the risks of metal-on-metal hip implants;
- the importance of metal ion testing; and
- the long-term considerations for patients implanted with metal-on-metal hip systems.
During the hearing, the FDA panel heard testimony from patients, medical device manufacturers, experts, medical professionals, scientists, consumer advocacy groups and foreign regulatory agencies.
In light of the testimony the FDA received during the hearing, and recent reports that the agency has received nearly 17,000 adverse events related to metal-on-metal hip implants between 2000 and 2011, the lawyers representing clients in the DePuy ASR litigation are hopeful that the FDA takes action soon to protect public safety.*****
