On July 20, 2012, the labor and employment law firm Blumenthal Nordrehaug & Bhowmik filed a class action wage and hour Complaint against Best Buy Stores, L.P. (“Best Buy”) alleging Best Buy wrongfully classified their Assistant Store Managers as exempt from overtime and therefore failed to pay all wages due to these employees for overtime hours worked. Kurt Swanson and Tawny Perez, et al. vs. Best Buy Stores, L.P., Case No. 30-2012-00585319-CU-OE-CXC is currently pending in the Orange County Superior Court for the State of California.
The Class Action Complaint alleges that the Assistant Store Managers spent the majority of their time performing non-exempt work tasks throughout their shifts. The wage and hour Complaint states that the tasks required to be performed by the Assistant Store Managers included taking inventory, setting up product displays, and greeting customers. Furthermore, the Complaint alleges that the Assistant Store Managers possessed a very minor role in supervising other employees. Based on these alleged facts, the Complaint claims that the Assistant Store Managers were misclassified as exempt and should have been properly classified as non-exempt employees entitled to overtime wages and other related benefits.
