The State Attorney’s office conceded to the motion and agreed to reduce the DUI charges against Ms. Rizzo’s client to reckless driving with no formal conviction, leaving the client the option to seal the record.

Florida criminal defense lawyer AnneMarie Rizzo of the law firm of Finebloom, Haenel & Higgins was recently able to convince prosecutors to reduce DUI charges against her client to reckless driving, with no formal conviction.

According to court documents, the driver was stopped by the Florida Highway Patrol for failing to maintain a single lane. The trooper noted signs of impairment: odor of alcohol, slurred speech and bloodshot, watery eyes. The driver was asked to perform field sobriety tests, on which the trooper reported that she did poorly. At this point, the trooper made an arrest for DUI and the defendant was transported to jail, where she took a breath test and blew over .15 – more than double the legal limit.
