Picture It Settled®, makers of software that helps litigants analyze case positions and plan strategic concessions in negotiation, announced today that it has received trademark registration certificates from the U.S. Patent and Trademark Office.

Picture It Settled®, makers of software that helps litigants analyze case positions and plan strategic concessions in negotiation, announced today that it has received trademark registration certificates from the U.S. Patent and Trademark Office for Picture It Settled® in three international classes:

1.    Computer software for analyzing and facilitating legal case evaluations, settlements, and business negotiations;
2.    Education and training services, namely, classes, seminars, roundtable discussions and lectures in the field of legal case evaluations, settlements, and business negotiations; and
3.    Dispute resolution services provided online.

Attorney-Mediator Don Philbin developed Picture It Settled® in collaboration with Southwest Research Institute®. The program uses patent-pending algorithms, neural networks, and data from thousands of cases and court statistics to help negotiators analyze case positions and plan strategic concessions in negotiation. The Lite version, which is available for free on Android, Apple, and BlackBerry smartphones, easily tracks dollar moves and the time intervals between them. It then projects the intersection point in both dimensions. With each move, the App also offers pre-calculations based on negotiation theory.

Don Philbin, J.D., M.B.A., LL.M., is an AV-rated attorney-mediator and adjunct professor of law. Philbin has extensive experience and education in the fields of business, law, negotiation, and mediation, and mediates individual and class matters in a range of substantive areas. He teaches academic and professional skill courses at Pepperdine Law’s Straus Institute for Dispute Resolution.
