Vaginal mesh lawsuits continue to be filed by Bernstein Liebhard LLP, a nationwide law firm representing clients who have been injured by dangerous drugs and defective medical devices, on behalf of individuals who were injured by transvaginal mesh.
New York, NY (PRWEB) July 31, 2012
Vaginal mesh lawsuits in the federal consolidated action, In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (“MDL No. 2327”), are subject to a newly issued Stipulated Protective Order following a July 26, 2012 status conference, Bernstein Liebhard LLP reports.* On July 30, 2012, the Honorable Joseph R. Goodwin, who is overseeing the pelvic mesh litigation currently pending in the U.S. District Court for the Southern District of West Virginia, issued an order governing the confidentiality of documents during the discovery and post discovery phases of the pelvic mesh litigation. In addition to the federal pelvic mesh litigation against Ethicon, Judge Goodwin is also overseeing the following related actions against other transvaginal mesh manufacturers: In re: American Medical Systems, Inc., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2325”); In re: Boston Scientific Corp., Pelvic Repair Systems Products Liability Litigation (“MDL No. 2326”); and In re: C.R. Bard, Inc., Pelvic Repair System Products Liability Litigation (“MDL No. 2187”). The transvaginal mesh lawsuits allege that transvaginal mesh manufacturers produced defective implants causing plaintiffs to sustain serious injuries.
Vaginal mesh lawsuits continue to be filed by Bernstein Liebhard LLP, a nationwide law firm representing clients who have been injured by dangerous drugs and defective medical devices, on behalf of individuals who were injured by transvaginal mesh. Firm partner Jeffrey S. Grand serves on the Plaintiffs’ Steering Committee in each of the federal transvaginal mesh lawsuits. Mr. Grand also serves as Co-Liaison Counsel in In re Pelvic Mesh/Gynecare Litigation, No. 6341-10 (N.J. Super Ct.) and In re Pelvic Mesh Litigation/Bard No. L-6339-10 (N.J. Super. Ct.), which are two consolidated actions of all the vaginal mesh lawsuits filed in New Jersey state court.
Vaginal Mesh Lawsuits: Implication Of The Protective Order
One of the main purposes behind a Protective Order is to shield a company from competitive harm without infringing on plaintiffs’ right to consult with experts. Often, in complex litigations, experts are asked to opine on highly confidential information with respect to a corporate defendant. If this information were to be disclosed to a potential competitor, the defendant company could face significant harm. In the order, Judge Goodwin provided instructions regarding what documents counsel may deem confidential; how counsel can challenge whether information is, in fact, privileged; and how counsel can use and access confidential information during the course of the pelvic mesh litigation.
Bernstein Liebhard LLP is continuing to evaluate claims and actively file vaginal mesh lawsuits on behalf of individuals injured by transvaginal mesh. Those who have suffered damages from vaginal mesh implants may be entitled to compensation for medical expenses, pain and suffering, lost wages and other injuries.
