Debt Collection Agency, Rapid Recovery Solution, Inc, Adds Input To Minnesota Medical Collection Abuse Issue

In the wake of the $2.5 million lawsuit filed against medical collection agency, Accretive, debt collection agency, Rapid Recovery Solution, Inc, emphasizes that the medical collection agency’s actions were allegedly in clear violation of the code of ethics that collectors adhere to.

On August 6th, 2012, debt collection agency Rapid Recovery Solution, Inc. had been made aware of the controversial court decision to make medical collection agency, Accretive, pay up to $2.5 million in settlements to patient debtors that they allegedly harassed with intrusive collection tactics. Rapid Recovery went on to state that codes of ethics are in place for debt collectors in order to prevent incidents such as this from taking place.

According to various news reports dating back to before April, debt collectors working for Accretive acted as local Minnesota hospital employees and pushed patients for owed debts while the patients were undergoing surgeries or other medical procedures. If true, such collection methods border on extortion, since the patients would be forced to pay off debts in exchange for supposed medical care. As a result of the subsequent lawsuit (Civil File No. 12-145 RHK/JJK), Accretive ceased its methods of debt collection in Minnesota.

If the alleged reports of Accretive deceiving patients are unequivocally true, these debt collection methods violate many of the Code of Ethics as stated by the Commercial Collection Agency Association. First and foremost, as stated in article 3A, collectors must, “avoid deceptive practices, statements or materials which would cause debtors to believe they are dealing with someone other than the member.” This is a code that Accretive may well have violated in the case of their representatives posing as hospital employees.

“It’s hard enough to deal with the health care system, but having collectors pretend to be doctors is just sickening,” said John Monderine, President and CEO of Rapid Recovery Solution, Inc.

The ongoing case with Accretive was an isolated incident in the way of debt collection. Debt collection agency, Rapid Recovery Solution, Inc, further states that debt collection is a practice that is both lucrative and necessary for the agencies’ clients. However, if true, this would not justify collection methods that are unfair and abusive to debtors, such as actions that allegedly took place in Minnesota hospitals.
