Andres Alonso and David Krangle, founding partners of Alonso Krangle LLP, a law firm dedicated to fighting for the rights of serious defective drug injury victims, report that U.S. District Judge David Herndon has refused a Defense motion to dismiss Pradaxa bleeding and hemorrhaging lawsuits currently pending in U.S. District Court, Southern District of Illinois. Among other things, the drug’s maker, Boehringer Ingelheim, had argued that the cases should be dismissed because the Pradaxa label already includes information that the drug may cause serious and sometimes fatal bleeding. But in an Order dated July 25, 2012, Judge Herndon pointed out that in addition to alleging Boehringer Ingelheim failed to warn about an increased risk of excessive or uncontrollable bleeding with Pradaxa, Plaintiffs’ also claim that the drug maker did not adequately inform users or the medical community about the lack of a reversal agent for Pradaxa bleeding side effects. As such, Judge Herndon found that “including a warning about the risk of serious or fatal bleeding does not justify dismissal of plaintiff’s claims.”

Judge Herndon’s order was issued just one day before the U.S. Judicial Panel on Multidistrict Litigation heard oral arguments regarding the establishment of a multidistrict litigation for all federal claims involving Pradaxa side effects. According to Alonso Krangle LLP, if a Pradaxa multidistrict litigation is established, all such federal lawsuits will be transferred to a single federal jurisdiction before one judge. Multidistrict litigations are established when there exists a large number of claims involving similar allegations or facts. The process is designed to reduce duplicative discovery, eliminate contradictory pretrial rulings from different judges and to serve the convenience of the witnesses, the parties and the courts. The Panel is expected to render a decision on the proposed Pradaxa multidistrict litigation in the very near future. Pradaxa was introduced by Boehringer Ingelheim in October 2010, as a superior alternative to Coumadin (warfarin) for prevention of stroke among patients with non-valvular atrial fibrillation. Unlike warfarin, however, there is no readily available antidote for internal bleeding caused by Pradaxa. In December 2011, the U.S. Food & Drug Administration (FDA) released a safety communication warning patients of possible increased risk for bleeding events while taking Pradaxa. More recently, a report issued by the Institute for Safe Medication Practices reported that Pradaxa accounted for over 3000 serious adverse events in 2011, including over 500 patient deaths. According to a recent report from The Madison Record, 27 Pradaxa injury lawsuits are pending in 13 federal jurisdictions. All of the lawsuits allege Pradaxa caused Plaintiffs to suffer serious side effects, including internal bleeding and death. The complaints further allege that Defendants failed to adequately warn of the drug’s risks.
