On August 8, 2012, the United States Judicial Panel on Multidistrict Litigation announced the decision to move all Pradaxa litigation to the Southern District Court of Illinois. The notice of centralization is pursuant to 28 U.S.C. § 1404. This panel action seeks to centralize the 21 actions pending in 11 district courts across the United States. The panel found that the actions consist of common questions and that centralization will serve the convenience of the parties and witnesses involved. The centralization is also meant to eliminate duplicate discovery, inconsistent pretrial rulings, and conserve the resources of the parties and the courts.

The panel also recognized the increasing number of tag-along actions. There are actually 40 Pradaxa-related actions in total. The tag-along actions are pending in 12 other districts. All of the responding parties support centralization of the cases but disagree on the location of the centralization. The parties come from a variety of district courts in states such as Connecticut, Florida, Kentucky, Louisiana, Oklahoma, and Tennessee. The panel made their decision on the basis that 13 of the 40 total related actions are pending in the Southern District Court of Illinois.
The panel’s order also appointed a judge to preside over the matter. The Honorable David R. Herndon has been named as the jurist for Pradaxa litigation. He has previously overseen In re Yasmin and Yaz Marketing, Sales Practices & Products Liability Litigation, 655 F. Supp. 2d 1343 (J.P.M.L. 2009). He was appointed by former President William Clinton in 1998. Judge Herndon has been serving as the designated Chief Judge for nearly five years.
