On August 3, 2012, the Los Angeles employment lawyers at Blumenthal Nordrehaug & Bhowmik filed a class action complaint against The Wellpoint, Companies, Inc. ("Wellpoint") for alleged unpaid overtime wages. Talamantez, et al. vs. The Wellpoint Companies, Inc., Case No. BC489001 is currently pending in the Los Angeles County Superior Court.

According to the class action complaint filed against Wellpoint, the health benefits service provider paid their hourly employees incentive wages based on their performance with Wellpoint. According to the lawsuit, Wellpoint “failed and still fails to include the bonus compensation as part of the employees’ ‘regular rate of pay’ for purposes of calculating overtime pay.” As a result, the Complaint states that these employees were underpaid throughout their employment with Wellpoint.
