According to the class action complaint filed against Wellpoint, the health benefits service provider paid their hourly employees incentive wages based on their performance with Wellpoint. According to the lawsuit, Wellpoint “failed and still fails to include the bonus compensation as part of the employees’ ‘regular rate of pay’ for purposes of calculating overtime pay.” As a result, the Complaint states that these employees were underpaid throughout their employment with Wellpoint.
