This course is a must for owners and contractors who are interested in contracting with the federal government, and want to enhance their practical working knowledge of the federal reporting requirements and ground rules for past performance and responsibility.

Experts Michael Golden and Heather Kilgore Weiner of Pepper Hamilton, LLP will address how the government uses contractors’ past performance and integrity information in making award decisions, as well as the rules and issues relating to the Government’s collection and evaluation of past performance information and how those rules impact contractors.

The Government evaluates the past performance of contractors in almost every source selection, which often makes past performance a discriminator in whether a particular contractor wins a contract. Added to this, the federal Government recently implemented new reporting requirements for contractors that emphasize contractor monitoring and ensuring that contractors maintain solid performance records. Currently, all information posted to the Federal Awardee Performance and Integrity Information System (FAPIIS), excluding past performance reviews, is made publicly available on the FAPIIS website. The accessibility and public nature of this website and others makes available information about the performance and capabilities of companies available to both competitors and the Government.

Understanding the databases and other sources of information is critical to companies bidding on government contracts or that are considering bidding on government contracts. Knowledge of the basic ground rules governing how past performance is incorporated into the Federal Procurement System can impact whether a company wins or loses a contract.

Addressing webinar attendees will be Michael Golden and Heather Kilgore Weiner of Pepper Hamilton, LLP

Michael R. Golden is a partner in the Government Contracts Practice Group of Pepper Hamilton LLP. Before joining Pepper, Mr. Golden was managing associate general counsel for procurement law with the U.S. Government Accountability Office (GAO) in Washington, D.C. There he was responsible for the GAO’s Bid Protest Forum and the Contract Appeals Board. He approved all bid protest decisions issued by the GAO. Mr. Golden also has drafted procurement reform legislation and has testified before congressional committees on the federal acquisition process. The comptroller general has twice awarded Mr. Golden with a Meritorious Service Award.

Heather Kilgore Weiner is a senior associate in the Government Contracts Practice Group of Pepper Hamilton LLP. Over the past six years at Pepper Hamilton, Ms. Weiner has participated in the prosecution and defense of numerous bid protests before administrative agencies, the U.S. Government Accountability Office and the U.S. Court of Federal Claims. Ms. Weiner’s practice includes a wide range of other government contract issues including, proposal preparation and business counseling, small business issues, including size protests and NAICS code appeals, compliance reviews and audits, congressional investigations and subpoenas, General Services Administration and Veterans Affairs Multiple Award Schedules, Freedom of Information Act issues, domestic source restriction (i.e., Trade Agreements Act, Berry Amendment and Buy American Act) and claim preparation.

Following this presentation, there will be an interactive 10-to-15 minute question-and-answer session addressing material covered in the webinar.
