Tim ‘Dr. Hope’ Anders is an award-winning children’s book author and part-time poker professional. He has been a loyal and well-liked customer of Ocean’s Eleven Casino in Oceanside, CA since it opened.
On July 20, Mark Kelegian filed a request for civil harassment restraining order, case # 37-2012-00055509-CU-HR-NC against Tim Anders in the Superior Court of California, County of San Diego, North County Division. According to court documents, when Dan Dreger and Bob Moyer, both well-liked managing partners retired, the management of Ocean’s Eleven Casino in Oceanside, CA was taken over by Mark Kelegian, the son of Haig Kelegian, the second largest investor in Ocean’s Eleven.
The case files state that Tim Anders wrote a letter to the majority interest holder in Ocean’s Eleven complaining about how he believed the new management was treating the employees. Within a few weeks of writing the letter he was banned from Ocean’s Eleven. The court record then indicates that Mr. Anders built a blog type website where the employees and customers could freely state their opinions without fear of retaliation.
In Ander’s sworn declaration on file in this lawsuit he states: “Within a couple of days I got a letter from Mark’s attorney demanding that I take down the site within 72 hours alleging that it was slanderous… I did, however, leave the site up for one reason: I feel that the employees should be able to speak their minds without fear of retaliation. I am an American that believes in the first amendment to our constitution, the right to free speech.”
According to court records Tim won at the hearing on civil harassment. On August 10, 2012 Mark's case for civil harassment # 37-2012-00055509-CU-HR-NC against Tim Anders was dismissed with prejudice (meaning that Mark could not re-file against him).
According to court records another case #37-2012-00055763-CI-DF-NC is now pending against Tim Anders in the Superior Court of California, County of San Diego, North County Division, filed by the same attorneys. This case, among other things, seeks an order from the court enjoining Anders from using his blog website domain. To date that website is still up.
