Florida DUI lawyer AnneMarie Rizzo of the law firm Finebloom, Haenel & Higgins was recently able to convince prosecutors to reduce DUI charges against her client to reckless driving, with no formal conviction.

According to court documents, an off-duty Charlotte County sheriff’s officer observed the driver driving recklessly, and called an on-duty North Port Police officer to investigate. Upon contact with the driver, the officer reportedly observed several indicators of impairment and requested that the driver perform field sobriety tests. According to the officer, the driver did poorly on these tests and was subsequently arrested for DUI and transported to jail. At the jail, the defendant refused to comply with a breath test.

The defendant hired AnneMarie Rizzo of the law firm Finebloom, Haenel & Higgins for representation. Ms. Rizzo did her own intensive investigation of the case, gathering discovery and taking depositions. After her examination of the legal issues of the case, she filed a motion to suppress all evidence in the case. The State conceded to this motion and agreed to reduce the DUI charges against Attorney Rizzo’s client to reckless driving and a withhold of adjudication, allowing for the arrest records to be sealed at a later date.
