Johnson & Johnson subsidiary DePuy Orthopaedics, manufacturer of the embattled ASR systems, on August 24, 2010, publically announced a recall of the ASR Hip Resurfacing System and the ASR XL Acetabular System. This recall announcement might have been the start of a two-year period established by applicable law in which any person with a claim for damages against DePuy had to file a lawsuit. With the passing of two years on August 24, 2012, the time to file suit might have ended.
This does not mean, however, that anyone with a valid claim against DePuy seeking compensation for harm allegedly caused by an ASR device should assume that his or her claim is barred. If a judge were to rule that a different start date or a longer time period applies, then the end date for claims might be later than the second anniversary of the public recall announcement.
