Wright & Schulte LLC, a leading national injury and Ohio personal injury law firm has filed a Skechers Shape-Up injury lawsuit on behalf of a Detroit, Michigan, woman who suffered a torn meniscus, allegedly due to her use of Skechers Shape-Ups toning shoes. The Skechers Shape-Up injury lawsuit, which was filed in the Skechers Toning Shoe Product Liability Litigation (MDL 2308) now underway in U.S. District Court, Western District of Kentucky, names Skechers USA Inc., Skechers USA Inc., II, and Skechers Fitness Group as Defendants. According to the lawsuit, the Plaintiff received a pair of Skechers Shape-ups in July 2009. After initially wearing the toning shoes for 25-45 minutes the first two weeks after purchase, she began wearing the Skechers Shape-Ups during her daily activities. On August 1, 2009, the Plaintiff was preparing to go jogging, when suddenly and without warning, one of her Skechers Shape-Ups rolled forward and caused her to fall in excruciating pain. On August 8, the Plaintiff underwent an MRI which demonstrated she had a tear in the anterior horn of the lateral meniscus. On December 3, 2010, she underwent surgery to repair her torn meniscus, and has since undergone physical therapy. In addition the Plaintiff has received a recommendation from her doctor to receive cortisone injections twice a year. The Plaintiff claims that she has incurred significant medical expenses, could incur future medical expenses, and has suffered physical pain and mental anguish. Additionally, she is now at increased risk for future health problems and disability, the complaint alleges.
The Plaintiff alleges that after seeing many television and print advertisements touting the benefits of Skechers Shape-up toning shoes, she was were lulled into purchasing a dangerous product that the Defendant knew produced a substantial risk of causing chronic injuries and inducing falls. The toning shoes’ rocker bottom soles are designed to create instability and to change gait mechanics. The complaint alleges, however, that it is well established in the medical literature that changing one’s gait can and does cause chronic injuries. The complaint further alleges that the health risks of Skechers outweigh the absence of any benefit provided to the wearer. Among other things, the lawsuit points out that in April 2011, Consumer Reports documented that Skechers has seen more reports of injuries or complaints than any other product in its database.
According to Skechers Shape-Up lawyers at Wright & Schulte LLC, this new lawsuit is just one of dozens now pending in the Skechers Shape-Ups multidistrict litigation in the Western District of Kentucky before U.S. District Judge Thomas B. Russell. In an Order dated August 22, Judge Russell appointed Richard W. Schulte, a partner with Wright & Schulte LLC, to the Plaintiffs’ Steering Committee in the Skechers Toning Shoe Products Liability Litigation (MDL #2308). Mr. Schulte will work with Plaintiffs’ Co-Lead Counsels and Liaison Counsel to coordinate and prosecute Skechers lawsuit injury claims on behalf of consumers who sustained serious injuries, allegedly due to Skechers Shape-Ups.
