Biomet M2a Magnum hip replacement lawsuits pending in federal courts nationwide may be consolidated into a multidistrict litigation following a hearing later this month, Bernstein Liebhard LLP reports.* On September 20, 2012, the United State Judicial Panel on Multidistrict Litigation (“JPML”) will convene to hear oral arguments as to whether Biomet lawsuits filed in federal courts nationwide over the Biomet M2a Magnum hip replacement devices should be consolidated and coordinated for pre-trial purposes before a single judge. On June 27, 2012, plaintiffs Leyda Ching and Diane Winningham filed a petition to centralize the Biomet lawsuits in the U.S. District Court for the Northern District of California or, in the alternative, the U.S. District Court for the Southern District of New York.** In support of their motion to form a multidistrict litigation (“MDL”) to handle cases filed by plaintiffs alleging injuries caused by the Biomet M2a Mangum hip implants, the plaintiffs argued that the “Biomet M2a Magnum is the next metal-on-metal hip implant that will benefit from consolidated pretrial proceedings through an MDL. As of May 31, 2012, the FDA has received more than 450 adverse event reports related to the M2a Magnum hip implant.”
