The claims made by the plaintiffs discussed above are representative of the hundreds of other lawsuits currently pending against Merck. Given that the femur is one on the strongest bones in the body, it is troubling that certain plaintiffs involved in the litigation sustained femur fractures as a result of low-impact falls, such as stepping off of a street curb or getting up from a chair.    

Although none of the Fosamax femur fracture lawsuits pending before Judge Higbee have gone to trial yet, on June 4, 2012, she sent a letter to counsel notifying them of her intention to move forward with a trial involving a femur fracture injury. While the first trial has yet to be scheduled, discovery is moving forward.
