Defendant fails to accurately calculate overtime hours worked by the Plaintiffs.
Los Angeles, CA (PRWEB) September 14, 2012
On September 6, 2012, the Los Angeles employment lawyers Blumenthal, Nordrehaug & Bhowmik filed a lawsuit against Mauran Ambulance Services, Inc. (“Mauran”) alleging they neglected to pay their employees all their overtime wages and failed to provide meal and rest breaks. Ritchie, et al. vs. Mauran Ambulance Service, Inc., Case No. BC491573 is currently pending in the Los Angeles County Superior Court.
The class action Complaint alleges that these non-exempt employees routinely worked in excess of 8 hours in a single workday and were never paid for their daily overtime hours. Furthermore, the complaint alleges that the employees sometimes worked in excess of 12 hours in a workday and Mauran failed to provide daily overtime compensation to them. California law mandates that non-exempt employees get paid overtime for all hours in excess of 8 hours in a workday.
Additionally, the complaint asserts Mauran failed to provide employees with meal rest breaks as their work hours accumulated throughout the workday. The complaint alleges Mauran made a deduction of one hour from the plaintiffs' time logged each shift, however the vast majority of the time Plaintiffs were unable to take a bonafide meal and rest break.
Managing partner, Norman B. Blumenthal, stated “In California, when non-exempt employees work over 8 hours in a given day, they should be getting paid overtime for those hours even if they aren’t working over 40 hours a week.”
