Duffey, Jr., who is overseeing the federal Wright Conserve hip lawsuits pending in the U.S. District Court for the Northern District of Georgia, issued a discovery order directing Wright Medical to produce certain documents pertaining to its Profemur hip neck stems after plaintiffs argued that the Profemur neck stem was an integral part of the flawed design for the Wright Conserve metal-on-metal hip replacement system, which is the subject of this multidistrict litigation. In granting plaintiffs’ request, Judge Duffey wrote, “The Court finds that information regarding the Profemur neck is relevant to the claims in this action and reasonably calculated to lead to the discovery of admissible evidence.” As outlined in the order, plaintiffs are entitled to information and documents regarding the neck’s design and function as well as information concerning any notice and investigation of Profemur defects, such as corrosion, fretting or failure.
