Is obesity covered by the American with Disabilities Act?

The Center for Disease Control and Prevention (“CDCP”) has found that over one-third adults in the United States of America suffer from obesity, leading to estimated $147 billion in healthcare costs related to obesity. It defines obesity as a person with a body mass index (“BMI”) of over thirty (30%) percent. Obesity has become a serious epidemic affecting a large percentage of the population. Both employers and employees must be aware of how recent courts have viewed obesity as a disability.

The American with Disabilities Act of 1990 (“ADA”) was passed into legislation to prohibit discrimination based on disabilities. While there has never been a conclusive list of all the “disabilities” protected by the ADA, the ADA defines “disability” as follows: Disability: The term “disability” means, with respect to an individual; a physical or mental impairment that substantially limits one or more major life activities of such individual; a record of such an impairment; or, being regarded as having such an impairment.

According to the CDCP obesity rates in the United States have raised drastically since the 1990s. On March 31, 2008, the Equal Employment Opportunity Commission (“EEOC”) issued a informal discussion letter which partially addressed obesity and the ADA.
