Page, Arizona couple obtain One Million Dollars in Judgments against Drunk Driver

Aaron Alcala and Kelley Smith, Page, Arizona residents, obtained One Million Dollars ($1,000,000.00) in judgments (five hundred thousand dollars each) against Jayson Kidwell for personal injuries they sustained when their vehicle was struck head-on by Kidwell’s vehicle, whose was driving under the influence of alcohol. Mr. Alcala and Ms. Smith were represented by Phoenix attorney Michael Córdova.

    On June 27, 2010 at approximately 1:00 a.m., Aaron Alcala and Kelley Smith were on the way to the store to get some ice cream near Fort Mohave, Arizona. Jayson Kidwell, who was intoxicated at the time, was driving eastbound on Aztec Road when his vehicle crossed over into oncoming traffic and caused a severe head-on collision with Mr. Alcala and Ms. Smith’s vehicle.

Both Aaron Alcala and Kelley Smith were rushed to the hospital after the collision. Aaron suffered two broken wrists, which required surgery. In total, he incurred over $100,000.00 in medical expenses as a result of his injuries. Kelley suffered a broken left wrist and a broken right shin, which both required surgery. In addition, Ms. Smith had to undergo knee surgery as a result of the collision. Her medical expenses totaled over $200,000.00.

A lawsuit was filed on behalf of Mr. Alcala and Ms. Smith by the Law Offices of Michael Cordova against Jayson Kidwell on December 22, 2010, Alcala v. Kidwell, CV2010-2760 in the Superior Court of Mohave County. The plaintiffs argued Jayson Kidwell negligently operated his vehicle when he crossed into oncoming traffic and collided with their vehicle. In addition, the plaintiffs sought punitive damages for Jayson Kidwell’s reckless disregard for the safety of others when he drove his vehicle while under the influence of alcohol.

    On January 6, 2012, Mohave County Superior Court Judge Charles W. Gurtler, Jr. entered judgment against Jayson Kidwell in the amount of five hundred thousand dollars ($500,000.00) for Aaron Alcala and five hundred thousand dollars ($500,000.00) for Kelley Smith, for a total of One Million Dollars ($1,000,000.00).
