The Consumer Justice Foundation, a for-profit corporation whose team of consumer advocates provides free educational online resources to the public regarding the potential dangers related to using certain types of prescription medication, hereby alerts the public to an announcement made by the Attorney General of Mississippi that the office has agreed to a settlement with Abbott Laboratories for its alleged deceptive marketing practices regarding Depakote, an anticonvulsant medication that is meant to be used for the treatment of epilepsy, migraine headaches and the manic episodes associated with bipolar disorder.
Attorney General Jim Hood made the announcement on Monday to his constituents that this Depakote marketing settlement agreement had been reached along with settlements for several other matters. Abbott Laboratories agreed to pay the State of Mississippi a total of $840,000.00 These allegations were never brought to court in a specific lawsuit and therefore do not have a case number, but the settlement will allow the matter to avoid litigation. The announcement was published in a story released on September 17, 2012 that appears on the Web site of WTVA in Tupelo.
These Depakote marketing allegations specifically dealt with accusations that Abbott Laboratories engaged in marketing practices for this medication that intended to promote Depakote for off-label uses, or uses not approved by the FDA. The state alleged that Abbott Laboratories marketed Depakote for use by the elderly to treat symptoms of dementia, and dementia has never been an approved condition for Depakote use.
This settlement will now bring this matter regarding Depakote to a close with regards to potential enforcement by state law enforcement officials. However, it will not prevent those who believe that they have suffered as a result of Depakote side effects to bring legal claims against Abbott Laboratories as individuals or as members of a class of consumers.
