Portland Car Accident Attorney Honored at Oregon Trial Lawyers Association Luncheon for Protecting the Rights of Small Crash Victims

Portland car accident attorney Joshua Shulman, a partner at Shulman DuBois LLC, has been asked to speak at a luncheon today for the Oregon Trial Lawyers Association (OTLA) after his firm won a landmark trial against Geico. That trial’s decision upheld Oregon statute 20.080, which protects consumers from auto insurance companies.

Attorney Joshua Shulman, from the auto accident law firm of Shulman DuBois, and attorney Shenoa Payne, from the law firm Haglund Kelley Jones & Wilder, have both been invited to speak at a special luncheon hosted by the Oregon Trial Lawyers Association (OTLA).

The luncheon is one of several being held to promote Continuing Legal Education for Oregon attorneys in the area of motor vehicle litigation. Shulman, an experienced auto accident attorney, has been personally asked to speak based on his firm’s work and dedication to ORS 20.080.

In the case of Juan Iniguez-Reyes v. Rachel Kambeitz (Multnomah County, case no. 1103-03206), Shulman DuBois LLC was able to recover $70,000 after a successful trial brought under ORS 20.080. Kambeitz was insured by Geico, and therefore the company paid the attorney fees.

“ORS 20.080 is one of the most important laws we have in Oregon for personal injury cases. ORS 20.080 helps ensure that auto insurance companies do not take advantage of car accident victims,” Shulman said. He is proud to have been asked to present at the OTLA luncheon. The Oregon Trial Lawyers Association is an organization dedicated to protecting the rights of consumers through the justice system.

ORS 20.080 states that if, after receiving a low offer, the injured plaintiff hires an attorney and gets a higher award at trial, the defendant (person who caused the accident) is responsible for paying the attorneys’ fees and all case costs (through their insurance policy). This gives personal injury lawyers an incentive to take smaller cases.

“We were happy that we really were able to recover so much of our fees from this case. While ORS 20.080 states that attorneys should be able to recover fees, this is not always the case,” Shulman said. “That’s why OTLA wants us to present – so we can all begin to understand how to combat the insurance company’s arguments against fair fees.”

He and Payne, who helped prepare the pleadings in the fee petition, will be explaining to fellow attorneys how to argue for attorneys’ fees when insurance companies try to draw out negotiations and use the high cost of litigation to deter claimants. Their experience in building a case, and keeping good records of costs and fees, will hopefully be of value to other auto accident lawyers in Oregon.
