On September 11, 2012, Blumenthal, Nordrehaug & Bhowmik, a prominent employment law firm in San Francisco, filed a class action complaint against O'Reilly Autoparts a.k.a. CSK Auto, Inc. (“CSK”) for alleged wage and hour violations.
Under California labor laws, businesses that provide non-discretionary bonuses in their compensation plans must include those mandatory bonuses when calculating their non-exempt employees’ regular and overtime rates of pay.
The class action complaint alleges that CSK provides mandatory bonuses to their employees but fails to account for these bonuses in calculating their employees’ overtime rates of pay. The complaint further alleges that as a result, the employees of CSK were shorted on their overtime wage payments.
