This case has been settled outside of court. Maria Hinojosa, Santiago Hinojosa and their three children, Gustine, California residents, agreed to accept One Hundred Sixty One Thousand Eight Hundred Fifty Dollars ($161,850.00) from Tesla Motors and Mark Baschke for personal injuries they sustained when they were injured in a truck accident on Interstate 10 during a December 22, 2009 dust storm (according to Claim #074707). On December 22, 2009 at approximately 11:00 a.m., the Hinojosa family was traveling eastbound on Interstate 10 between Tucson and Phoenix when a heavy dust storm hit reducing visibility to zero. Almost all traffic came to a complete stop on the interstate as a result of the dust storm. However, Mark Baschke, a semi-truck driver for Tesla Motors, continued to drive down the highway. Mr. Bascke failed to notice traffic stopped in front of him and rear-ended multiple stopped vehicles, including the Hinojosa vehicle, before finally coming to a stop (according to Claim #074707).
Maria Hinojosa was air evacuated from the scene of the collision to Maricopa Medical Center. After being released from the hospital, she continued to suffer from pain and decreased range of motion in her left shoulder and arm. An MRI revealed her tendonitis in her shoulder as a result of the collision. Her treatment included painful injections and physical therapy to help her recover from the injury. Santiago Hinojosa and the children were diagnosed with minor soft tissue injuries (according to Claim #074707).
The Law Offices of Michael Córdova asserted personal injury claims on behalf of the Hinojosa family against Tesla Motors and Mark Baschke. The law firm argued Mr. Baschke was negligent when he failed to control his speed to account for traffic conditions, specifically the dust storm. In addition, the law firm argued Tesla Motors was responsible for the actions of its employee, Mark Baschke, at the time of the collision (according to Claim #074707).
Ultimately, the parties agreed to resolve the claims without filing a lawsuit. Tesla Motors and Mark Baschke agreed to pay the Hinojosa family $161,850.00 in exchange for releases of liability.
