Washington, DC (PRWEB) September 28, 2012
ARPC, an expert services and business advisory consulting firm providing world-class analytical expertise and guidance to clients facing complex legal and business challenges, has announced today that the Company was retained earlier this year by the law firm Finnegan, Henderson, Farabow, Garrett & Dunner, LLP to provide economic expertise in a patent infringement case brought by HTC Corporation, the creator of award-winning mobile devices including smartphones and tablets. The case (Inv. No. 337-TA-808) is currently before the International Trade Commission (ITC).
Senior Managing Director Donald L. Martin, Ph.D., has taken the lead for ARPC in developing opinions regarding relevant economic issues, including certain investments and expenditures and specific company operations that would reveal the existence of a domestic U.S. industry in products that involve certain patents owned by HTC. Dr. Martin delivered these opinions before the ITC at a trial earlier this month. The outcome of the case is still pending.
This mobile industry patent infringement matter is the fourth in number of such litigation matters that ARPC has handled in 2012 alone.
“ARPC has extensive experience with patent infringement matters related to complex products like mobile devices which contain dozens or even hundreds of different patented technologies. We are seeing increasing demand for the expertise of Don and his team of economists in these more complex intellectual property cases,” explained John Brophy, ARPC Partner. “With the amazing growth of the mobile industry around the world, it is not surprising to witness the rising number of legal disputes touching this exploding industry and the ‘go-to’ role that ARPC has been playing in their resolution. In addition to ARPC’s knowledge and understanding of the mobile industry, Don’s broad experience in representing companies involved in litigation and regulatory issues spans consumer food products, semiconductor chips, professional sports, health care services and products, and residential real estate services among others,” he added.
“In the various cases in which we are retained, involvement may occur throughout any of the stages of the litigation process,” Dr. Martin said. “From working with counsel in the discovery process including participating in developing interrogatory questions and responses, to forming written opinions, testifying about them and rebutting the opinions of opposing experts, our litigation support services have been sought by both plaintiffs and defendants,” he explained.
Dr. Martin has more than 30 years of experience as an economic consultant, specializing in the application of microeconomic theory to intellectual property rights and antitrust issues. He has testified as an economic expert on liability and damage issues before U.S. District Courts, state courts, the International Trade Commission, the U.S. court of International Trade, proceedings conducted by the American Arbitration Association and proceedings before the European Commission. He has written more than 20 scholarly books and articles dealing with economic topics, including the economics of intellectual property rights including their valuation and enforcement.
