Attorney Alex Galindo with the law offices of Curd, Galindo & Smith, LLP filed suit for Brad Terry, an automobile mechanic of Long Beach, California. The lawsuit against Western Hoist alleges Mr. Terry sustained injuries after the hoist failed and a car fell on to Mr. Terry's body. Court documents state that a new party was added to the complaint. The court document, an amended complaint alleges that Fenner Drives, Inc of Manheim, Pennsylvania manufactured a defective pulley which fractured causing the hoist to fail.
The trial judge set the matter for a jury trial to commence April 8, 2013 in the Los Angeles Superior Court, Case No.: TC025277.
Court records show that Brad Terry alleges in his lawsuit against Western Hoist that the hoist failed as a result of a defective wheel in the pulley system. The lawsuit contends that on May 20, 2010, Brad Terry was working on a vehicle at his employer's (Cormier Chevrolet) facility. The vehicle was raised on the hoist manufactured and sold by Western Hoist. The hoist failed and the vehicle came crashing down onto Mr. Terry. As a result Brad Terry suffered significant and life long injuries.
Mr. Terry is seeking general and compensatory damages in an amount to be proven at trial for past and future loss of earnings, lost earning potential and past and future loss of self, including pain and suffering.
