The transvaginal mesh lawsuit, which was filed in In re: American Medical Systems, Inc., Pelvic Repair System Products Liability Litigation (MDL No. 2325) now underway in U.S. District Court, Southern District of West Virginia, names American Medical Systems, Inc., along with Endo Pharmaceuticals, Inc. and Endo Health Solutions Inc. as Defendants (Case No. 2:12-cv-07402).
Transvaginal mesh products like the SPARC Sling System are used in urogynecologic procedure to reinforce the weakened vaginal wall in pelvic organ prolapse repair or support the urethra or bladder neck for the repair of stress urinary incontinence. The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of transvaginal mesh products, and in July 2011 issued a Public Health Notification warning that serious injuries associated with surgical mesh for transvaginal repair of pelvic organ prolapse, including neuromuscular problems, vaginal scarring/shrinkage and emotional problems, were “not rare”. The FDA further concluded that transvaginal pelvic organ prolapse repair with mesh “does not improve symptomatic results or quality of life over traditional non mesh repair.”
The American Medical Systems transvaginal mesh litigation is one of five pending in the Southern District of West Virginia before Judge Joseph R. Goodwin. Others include In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation (MDL No. 2327), C. R. Bard, Inc. Pelvic System Products Liability Litigation (MDL 2187); In re: Boston Scientific Corp., Pelvic Repair System Products Liability Litigation (MDL No. 2326); and In Re Coloplast Corp. Pelvic Support System Products Liability Litigation. According to Court records, the first trial in the C.R. Bard transvaginal mesh litigation will begin in February 2013. A trial involving an American Medical Systems pelvic mesh device is expected to begin in December 2013.
