Opening statements are on course to begin tomorrow in the first trial of one of the hundreds of cases included in a Gynecare vaginal mesh mass tort in New Jersey Superior Court, the Rottenstein Law Group reports.

For many women who’ve been injured by vaginal mesh, it’s still not too late to file a claim.

Jury selection began January 7 in a case alleging that a vaginal mesh product called Gynecare Prolift caused 47-year-old Linda Gross to suffer debilitating pain and undergo 18 subsequent operations, according to Bloomberg. (Gross v. Gynecare Inc. Atl-L-6966-10, Superior Court of Atlantic County, New Jersey (Atlantic City)). The case is the first of the 1,800 Gynecare lawsuits pending in New Jersey Superior Court to go to trial, Bloomberg reports.

As of Wednesday afternoon, jury selection was on course to finish on time, allowing the parties to begin delivering their opening statements at 9 a.m. on Jan. 10, staff members in Presiding Judge Carol Higbee’s chambers reported in a telephone interview with the Rottenstein Law Group.

Gynecare Prolift is manufactured by Johnson & Johnson’s Ethicon unit, according to Bloomberg. In addition to the 1,800 cases that make up the Gynecare mass tort pending in New Jersey Superior Court, there are hundreds more vaginal mesh cases against Johnson & Johnson’s Ethicon unit consolidated into a federal multidistrict litigation claim in the U.S. District Court for the Southern District of West Virginia (In re: Ethicon, Inc., Pelvic Repair System Products Liability Litigation, MDL No. 2327).

As the representative of claimants allegedly injured by vaginal mesh products made by Ethicon and other manufacturers, Rochelle Rottenstein, the Rottenstein Law Group’s principal, implores women who believe they’ve been hurt by these implants to call the Rottenstein Law Group’s offices for a free evaluation of their ability to file a lawsuit right away.

“Now that one of the cases in the New Jersey mass tort action has gone to trial, resolution of hundreds of women’s claims against Johnson & Johnson and other vaginal mesh manufacturers is in sight,” Rottenstein says. “Nevertheless, for many women who’ve been injured, it’s still not too late to file a claim.”
