Wright & Schulte LLC, a leading Ohio personal injury law firm, announces they have filed another Imprelis lawsuit, this time on behalf of the owner of a golf course located in Versailles, Ohio. The Complaint, which was filed on January 5, 2013 in U.S. District Court, Southern District of Ohio, alleges that at least 120 trees located on the golf course were either damaged or killed as a result of Imprelis. (Case No. 3:13-cv-00004-TSB)

According to the complaint, the Plaintiff is in the business of providing its customers with challenging and enjoyable rounds of golf. Trees are vital to this business, as its chief draw is its landscape, grounds and undulating fairways and greens surrounded by trees. In the spring of 2011, the Plaintiff purchased Imprelis for use on the golf course, and the herbicide was applied to the property over the course of several days. The lawsuit alleges that Imprelis was purchased by the Plaintiff in an attempt to make the course more aesthetically pleasing; however, use of the product had the direct opposite effect. On November 1, 2012, a certified arborist visited the Plaintiff’s property and discovered browning, curling, signs of death and in some instances complete death on at least 120 trees.

According to the Imprelis lawsuit, Imprelis herbicide was introduced by DuPont in October 2010 and marketed as a safe and effective way to treat the most common and hard to kill broadleaf weeds present in turf grass without any negative impact on surrounding plants. However, the Plaintiff alleges that DuPont’s representation of Imprelis as being environmentally friendly and safe to use is simply not the truth. Rather, in its relatively short time on the market, DuPont’s Imprelis has proven to be a frighteningly effective tree killer. After investigating hundreds of reports of Imprelis tree death throughout the Northeast and Midwest U.S., the Environmental Protection Agency issued a Stop Sale and Removal Order for Imprelis in August 2011. By the time Imprelis was pulled from the market, it had killed or damaged thousands of ornamental landscape trees, including Norway spruces, eastern white pines, conifer trees, willow trees, poplar trees, deodora cedars, and balsam fir trees, according to the lawsuit.

Thousands of other property owners from the U.S. have filed similar Imprelis lawsuits against DuPont in order to obtain compensation for their damaged and dead trees. Many of those complaints have been consolidated in U.S. District Court, Eastern District of Pennsylvania before Judge Gene E.K. Pratter (In re Imprelis Herbicide Marketing, Sales Practices and Products Liability Litigation, Case No. 11-md-2284). A proposed settlement of those claims is now awaiting court approval.
