A Class action lawsuit has been filed against Autozone for allegedly violating overtime laws by failing to pay employees the proper amount of overtime wages.

On December 21, 2012 the Los Angeles employment attorneys at Blumenthal, Nordrehaug & Bhowmik filed a class action complaint against Azer California, LLC ("Autozone") for allegedly failing to pay their employees the proper amount of overtime compensation. Burton vs. Azer California, LLC, Case No. CV 120748 is currently pending in the San Luis Obispo County Superior Court.

According to the class action complaint filed against Autozone, the auto parts company paid their non-exempt employees a non-discretionary bonus based on their performance. According to the Complaint Autozone, “failed and still fails to include the bonus compensation as part of the employees’ ‘regular rate of pay’ for purposes of calculating overtime pay.” As a result of the alleged unlawful wage and hour policy of Autozone, the lawsuit claims hundreds of employees have been shorted their overtime wages.
