Alonso Krangle LLP, an experienced harmful drug law firm focused on fighting for the rights of seriously injured drug victims, reports that U.S. District Court Judge Rufe announced last month in a Pre-trial order that the first trial for Zoloft birth defect lawsuits allegedly caused by the Pfizer drug Zoloft, an antidepressant of the selective serotonin reuptake inhibitor (SSRI) class,will be heard in September of 2014. At least 250 Zoloft lawsuits have been consolidated in the multidistrict litigation, (MDL 2342) In Re: Zoloft (Sertraline Hydrochloride) Products Liability Litigation in the United States District Court for the Eastern District of Pennsylvania. Roughly 70 additional lawsuits filed in state courts in Illinois, Missouri, New York, Pennsylvania, and West Virginia. In total, more than 320 lawsuits have been filed. Judge Rufe ordered that proposals for the selection of the Initial Discovery Group Cases were to be submitted by January 11, 2013 and that by March 15, 2013, both parties were to submit proposals for the selection of the Trial Pool Cases. These bellwether cases help the court determine the scope of the MDL, while maintaining resources.

Zoloft Birth Defect Lawsuits
The MDL was established in April 2012 with plaintiffs alleging that taking the anti-depressant Zoloft, which is classified as a selective serotonin reuptake inhibitor (SSRI) during pregnancy causes birth defects. Zoloft is manufactured by drug manufacturing giant Pfizer.

According to the legal journal the West Virginia Record, nineteen lawsuits against Pfizer were filed in Wayne Circuit Court, WV, alleging that the babies born to mothers who had taken Zoloft as prescribed during their pregnancy suffer congenital defects such as holes in the heart, neural tube defects, atrial septal defect, persistant pulmonary hypertension of the newborn (PPHN), craniofacial defects, and other malformations. One of the most recent cases to be filed in the MDL involves a child born in 2008 to his mother who ingested Zoloft during her pregnancy as directed. The case alleges that the child was born with Hypospadias, a defect in which the urethra opening is on the underside of the penis instead of on the end. The plaintiffs allege in the lawsuit that “Pfizer knew or should have known that Zoloft crosses the placenta, which could have substantial implications for the developing fetus.” The lawsuit also contends that “preclinical studies and subsequent published studies” confirmed the risks posed to the babies, and “failed to fully, truthfully and accurately disclose Zoloft data to the FDA, and as a result negligenty, intentionally and fraudulently misled the medical community, the consuming public, including” the plaintiffs, “about the high risks to the fetus associated with the use of Zoloft during pregnancy,” the Pennsylvania Record reports.
