According to a New York Times article titled: Maker Hid Data About Design Flaw in Hip Implant, Records Show, more than 10,000 lawsuits have been filed against Johnson & Johnson after the company knowingly distributed the device with documented high-failure rates. There has been a 40 percent malfunction rate in all DePuy ASR Hip Implants to date.
Under the The Food and Drug Administration's Medical Device Recall page (http://www.fda.gov/MedicalDevices/ProductsandMedicalProcedures/ImplantsandProsthetics/MetalonMetalHipImplants/ucm241770.htm), a voluntary recall in 2010 was made, citing the DePuy ASR's unacceptable failure rate, with the device failing within five years of usage. Their findings were based off new, previously unpublished data taken from the UK joint registry.
