Collection Agency, Rapid Recovery Solution, Comments On Using Social Media To Contact Debtors Cited in the San Francisco Gate

After an article posted by San Francisco Gate discussed collection agencies targeting potential debtors on social media sites, debt collection agency Rapid Recovery Solutions affirmed that using social media is a violation of privacy.

On January 31, the CEO of Rapid Recovery Solution responds to an article published by San Francisco Gate with regard to debt collectors contacting debtors on social media.

According to the article published by San Francisco Gate some debt collectors have resorted to messaging debtors on Facebook. However, the Federal Trade Commission and the U.S. Consumer Financial Protection Bureau (CFPB) are determining whether or not using social media to hound debtors is legal and what the restrictions are.

After an influx of complaints in 2011 regarding how debt collectors were contacting people, the article said regulators imposed federal restrictions over the entire debt collecting industry.

In the article, former director of consumer financial protection, David Vladeck, said the Consumer Financial Protection Bureau should clarify and restrict ways debt collectors can contact debtors because it’s an invasion of privacy. Vladeck said electronic tools, such as Facebook, Twitter or even work e-mail accounts, are considered public platforms. If debt collectors use these platforms, third parties could potentially see private information, which is in violation of the law. He said the CFPB should restrict collectors from using social media.

John Monderine, CEO of collection agency Rapid Recovery Solution, said some agencies go overboard when trying to contact a debtor. “Sometimes agencies choose the wrong approach when trying to contact a debtor,” Monderine said. “While the objective is to retrieve owed money, we also try to help the debtor. If you harass them on Facebook by posting on their wall or messaging them, they are not going to give you anything.”

He said using social media isn’t a wise idea for debt collectors and federal regulations should be implemented. “Solidifying a circle of trust with the debtor is what’s important,” he said. “Using social media is a violation of privacy and it’s not going to make your collection agency look good. It’s also a gray area in the law because social media is so public.”
