Mark Tratos, an entertainment shareholder in the Las Vegas office of the international law firm Greenberg Traurig, LLP, and Tucker McCrady, an entertainment Of Counsel in the firm’s New York office, will speak at Practising Law Institute’s (PLI) Advanced Licensing Agreements 2013 program.
The event will be held on three separate dates in three different U.S. cities. The first program will be held both live and via webcast in San Francisco on January 30th and 31st, the second program will be held live in New York City on March 21st and 22nd, and the final program will be held live in Chicago on April 25th and 26th. Tratos will be at each program and McCradywill speakat the program in New York.
Tratos and McCrady will splitspeaking duties on a panel taking place during the first day of the program. The panel, titled “Analysis of a Content License Agreement,” covers several topics: walkthrough and mock negotiation of a complex content license agreement; structuring intellectual property rights allocation; negotiating new media rights; allocation merchandising rights; negotiating creative, business and technology control issues; funding and royalty-sharing considerations; and interplay of technology and content issues for digital content. Tratos will cover this panel in both San Francisco and Chicago and McCrady will be at the panel in New York. In all three programs Tratos will also be give a presentation during the second day titled, “Rights of Publicity Licensing,” which will cover the following topics: “natural” vs. statutory rights; lifetime vs. postmortem rights; rights of publicity in “identifiable objects” symbolizing a persona; rights of publicity releases; liability for violating a right of publicity; and differences compared to copyrights and rights of privacy.
According to PLI, the program will feature updates on current legal developments, present case studies highlighting best practices, provide tactics for negotiating frequently contested issues, and provide guidance on identifying and avoiding common pitfalls, keeping the relationship on track, litigation planning and avoidance, and addressing ethics concerns. The speakers will illustrate both outside counsel and in-house perspectives.
Tratos is the foundings Shareholder of the firm’s Las Vegas office and focuses his practice on a variety of entertainment, intellectual property and litigation matters. His representations include numerous artists and performers, resort, hotel and casino entities in federal court litigation involving trademark, copyrights, domain names, rights of publicity and privacy law for known casino brands. He currently represents many of the largest resorts in the world on brand development and protection strategies, enforcement and infringement litigation. He received his J.D. from Lewis & Clark Law School and his B.A. in Political Science from the University of Nevada, Las Vegas.
McCrady focuses his practice on entertainment law, with an emphasis on copyright, intellectual property and contracts. He has negotiated national and international digital music agreements, and has advised clients on a wide range of intellectual property matters, including in connection with asset purchase agreements, security agreements and merger agreements. McCrady also has experience with intellectual property litigation, has represented a leading toy-game manufacturer in trademark and copyright matters, and was formerly head of litigation at a major record label.
