A Wallin & Klarich client is no longer required to register as a sex offender after being issued a Certificate of Rehabilitation for a prior conviction for indecent exposure in Orange County, California. The client was represented by top Orange County criminal lawyer, Stephen D. Klarich, of Wallin & Klarich.

According to court record from Orange County Superior Court Central Justice Center, the client was convicted in 1999 for indecent exposure, a misdemeanor in Orange County under California Penal Code section 314.1. As a result of the indecent exposure conviction, the client was placed on probation for three years, ordered to pay fines, and was required to complete 40 days of community service. In addition, the client was also required to register as sex offender with law enforcement pursuant to California Penal Code section 290.

Prior to seeking the help of Wallin & Klarich, the client had been registering as a sex offender for 13 years and would have been required to register for the rest of his life. After the client contacted Wallin & Klarich, Mr. Klarich referred the client to an experienced clinical and forensic psychologist. The psychologist evaluated the client and determined that he had been rehabilitated and did not pose any threat of committing a sex offense. Mr. Klarich presented the psychologist’s report and other vital information that showed the client had been rehabilitated in the form of a petition for a Certificate of Rehabilitation, which was filed with the Orange County Superior Court.

After the petition was filed, a hearing was held. At the hearing, Mr. Klarich presented the evidence and information that showed the client was completely rehabilitated and should not be required to register as a sex offender for the duration of his life. The court ultimately favored Mr. Klarich and the client, and issued a Certificate of Rehabilitation. As a result, the client no longer is required to register as a sex offender pursuant to California Penal Code section 290. The client is also able to obtain employment that he previously had been prevented from because of his sex offender status and no longer carries the burden of being labeled a sex offender throughout the community.
