In early August, the North Carolina Department of Transportation (NCDOT) gave the green light to the Right of Way Acquisition Branch to begin acquiring property for “Section D” of the overall plan to widen U.S. Highway 221 (NCDOT’s Meeting minutes, August 7, 2013).
This section (R-2915D) of US 221 begins south of NC 194 and extends to the US221 Bypass.
According to NC Eminent Domain Attorney Stan Abrams, this means that property owners will begin receiving offers from the NCDOT for their land, if they haven’t already.
“How property owners handle this next step may be critical in determining how much they receive for their land,” Abrams said. “In our experience, oftentimes these initial offers are much too low, due to appraisers often not being able to spend enough time to properly value each and every property.”
Abrams and his colleague, Jason Campbell, are both former NCDOT attorneys.
“While working for the DOT, we saw far too many property owners leave money on the table,” Campbell said. “We’re happy to offer case evaluations at no-cost to home and business owners that will be affected by the US 221 widening.”
Campbell said one of the main things they will relay to property owners is their “Second Check Method” – a way that property owners who need immediate cash for moving or other expenses can typically collect the DOT’s initial offer, without legally accepting it, and then negotiate for more.
