Pennsylvania DUI attorney Justin McShane has been integral in getting 20 DUI cases in Dauphin County dismissed due to inaccurate breathalyzer machines.

While representing the PA DUI case (3802(c)) of Jason Schildt in the Dauphin County Court of Common Pleas (Commonwealth vs. Jason Schildt, Dauphin CP, 2191-2012), defense lawyer Justin McShane propositioned the accuracy of the breathalyzer machines the police use to measure a DUI offender’s blood alcohol content. Upon investigation, it was decided that these breath test machines were not giving accurate readings of BAC levels beyond .15 percent. As a result, 20 PA DUI cases have been dismissed.

Furthermore, this groundbreaking decision can also affect thousands of other Pennsylvania DUI convictions. Judge Lawrence F. Clark, Jr. ruled that DUI offenses Intoxilyzer 5000EN breathalyzers have been providing questionable readings. The Intoxilyzer 5000EN is widely used throughout the state of Pennsylvania to determine blood alcohol content. Clark’s ruling will likely result in the reexamination of many DUI arrests throughout the state.
