Michigan e-commerce developer Spartan Internet is announcing its support of a recent ruling in a patent infringement lawsuit. Spartan Internet supports the ruling because of the precedent it sets for online retailers.

The decision made by an appeals district court for the Eastern District of Texas, in Soverain Software LLC. V. Newegg Inc. case no. 6:07 07-CV-0511 (2013), prevents Newegg from having to hand over a $2.5 million in a lawsuit filed by Soverain Software. According to court documents, Soverain has filed several patent lawsuits against popular online shopping sites in the past to collect licensing fees. This lawsuit was filed against Newegg and other online retailers and claims a patent infringement in regards to their shopping cart software.
Court documents show that Newegg lawyers argued that Soverain’s patents were invalid and pointed out that Newegg created their shopping cart with a completely different code, unaware of any patents that Soverain had.
According to this table, Soverain has filed numerous lawsuits against big corporations such as Zappos in case 6:07-cv-00511 and Victoria’s Secret in case 6:09-cv-00274. In 2007, Zappos settled the case. In 2009 the judge ruled in favor of Soverain, and ordered Victoria’s Secret to pay $9,200,000 plus running royalty of 1%. According to PCMag, Soverain owned many patents on certain technologies that are essential for companies like Zappos and Victoria’s Secret that utilize an e-commerce platform, such as adding items to a shopping cart.
