A lawsuit seeking class-action status to represent hourly workers of Aaron's, Inc. was filed by the San Diego Employment Lawyers at Blumenthal Nordrehaug & Bhowmik. Martinez, et al. vs. Aaron's, Inc., Case No. ECU07478 is currently pending in the Imperial County Superior Court for the State of California.
The suit asserts claims litigated in recent years against other companies, including large retail companies.
According to the class action complaint filed against Aarons, the non-exempt, hourly employees were paid non-discretionary bonuses that Aaron's failed to include into their base hourly rates for the purposes of calculating overtime pay. The failure to include the additional non-discretionary bonus wages for overtime purposes, according to the complaint, "has resulted in a systematic underpayment of overtime compensation" to the all non-exempt, hourly employees that have worked for Aaron's in California for the past four years. Aaron's attorneys have not yet responded to the lawsuit.
